We want you to have a rewarding experience while you’re exploring, evaluating, and purchasing our products, whether you’re in-person at a Pop-up Shop location or online at our digital Pop-up Shop on GoForRobert.com (collectively, the “Store”). The Site and the Store are the property of Garbareno, LLC ("Garbareno") and its subsidiaries, affiliates, and licensors. As used in these Terms & Conditions, "Garbareno," "us," or "we" refers to Garbareno, LLC and its subsidiaries and affiliates.

 

By placing an order or making a purchase at our Store, you agree to the terms below, along with the Site’s Privacy Policy and Terms of Use.

 

U.S. Sales and Shipping Only

 

The Store accepts orders from billing addresses within the U.S. and most U.S. territories. Products purchased online from the U.S. will only be shipped to addresses within the U.S. and are subject to U.S. and foreign export control laws and regulations. Products must be purchased, sold, exported, re-exported, transferred, and used in compliance with these laws and regulations. 

 

Store Return Policy

 

We believe you will be thrilled with the products you purchase from our Store. In the unlikely event that a product does not meet your expectations, most unopened items sold by the Store in new condition and returned within 15 days will be eligible for a refund or exchange. The return window begins once the order has been invoiced, which occurs when any part of the order is shipped. Some items have a modified return policy noted in the item description. Items that are opened, damaged, or do not have a receipt may be denied a refund or exchange. The product must be in its original condition with all included parts, accessories, and packaging. We will exchange it or offer a refund based on the payment method. Please note the following:

• All online orders will be required to pay for return postage, except in the case of a manufacturer defect, in which case a call tag will be placed for the product.

• Products can only be returned in the country where they were purchased.

• For returns of cash or cash equivalent over $750, Garbareno will mail a refund check within 10 business days.

• Returned products may require inspection. If approved, a refund or exchange will be issued within 10 business days.

• The Store does not take title to returned items until they arrive at our fulfillment center. At our discretion, a refund may be issued without requiring a return. In this situation, Garbareno does not take title to the refunded item.

• The following items cannot be returned:

  • Personalized items

  • Items that have been washed or worn

  • Specialty gift cards and pre-paid gift cards, except where required by law, cannot be returned or redeemed for cash or credit.

  • The Store does not accept returns of sealed goods, such as face masks, which are not suitable for return due to health or hygiene reasons. Any returned orders with face masks will not be available for reshipping and will be disposed of with no refund or exchange issued.

 

The Store reserves the right to refuse returns at its sole discretion. This policy shall be governed and interpreted in accordance with the English language, regardless of any translations made for any purpose whatsoever.

 

Shipping & Delivery, Risk of Loss, Returned Shipments

 

Since delivery of your order can be impacted by events beyond our Store’s control once it leaves our facilities, the Store cannot be held liable for late deliveries. We will, however, work with you to ensure a smooth delivery. 

 

As the Store takes care of the dispatch of the products you purchase, the risk of loss of, or damage to, products shall pass to you when you, or a person designated by you, acquires physical possession of the products. All purchases of physical items from the Store are made pursuant to a shipment contract. Except as otherwise set forth herein, the risk of loss for and title to products purchased from the Store passes to the purchaser upon delivery to the carrier.

 

When we receive a returned shipment, you will be notified via email. Unclaimed returns will be donated to charity after 30 days. If the courier deems your provided address insufficient, the shipment will be returned to our facility. You will be liable for reshipment costs once we confirm an updated address with you, if applicable. Shipments that go unclaimed are returned to our facility, and you will be liable for the reshipment costs to yourself or your end customer. Any returned orders due to an incorrect shipping address or failure to claim the shipment will not be available for reshipping and will be donated to charity at your cost without a refund.

 

User Transactions

 

If you wish to purchase any product or service made available through the Store (each such purchase, a "Transaction"), you may be asked to supply certain information relevant to your Transaction including, without limitation, information about your method of payment (such as your payment card number and expiration date), your billing address, and your shipping information. YOU REPRESENT AND WARRANT THAT YOU HAVE THE LEGAL RIGHT TO USE ANY PAYMENT CARD(S) OR OTHER PAYMENT METHOD(S) UTILIZED IN CONNECTION WITH ANY TRANSACTION. By submitting such information, you grant to the Store the right to provide such information to third parties for purposes of facilitating the completion of Transactions initiated by you or on your behalf. Verification of information may be required prior to the acknowledgment or completion of any Transaction.

 

All descriptions, images, references, features, content, specifications, products and prices of products and services described or depicted in the Store are subject to change at any time without notice. Certain weights, measures, and other descriptions are approximate and are provided for convenience purposes only. The inclusion of any products or services in the Store does not imply or warrant that these products or services will be available. It is your responsibility to ascertain and obey all applicable local, state, federal, and international laws (including minimum age requirements) in regard to the receipt, possession, use, and sale of any item purchased from this Store. By placing an order, you represent that the products ordered will be used only in a lawful manner. The Store reserves the right, with or without prior notice, to do any one or more of the following: (i) limit the available quantity of or discontinue any product or service; (ii) impose conditions on the honoring of any coupon, coupon code, promotional code, or other similar promotion; (iii) bar any user from making or completing any or all Transaction(s); and (iv) refuse to provide any user with any product or service. You agree to pay all charges that may be incurred by you or on your behalf through the Store, at the price(s) in effect when such charges are incurred including, without limitation, all shipping and handling charges. In addition, you remain responsible for any taxes that may be applicable to your Transactions.

The Store, our agents or delivery partners may call or text by telephone regarding your account, your Transactions or delivery of your purchases. You agree that we may place such calls or texts using an automatic dialing/announcing device. You agree that we may make such calls or texts to a mobile telephone or other similar device. You agree that we may, for training purposes or to evaluate the quality of our service, listen to and record phone conversations you have with us.

 

Availability, Errors & Inaccuracies

 

If an item is out of stock, the Store, may, in its sole discretion and at no extra cost to you, substitute another item for the out-of-stock item if the Store, in its sole discretion, determines that the identical brand and product is available in a form that is of equal or greater value, for example, larger quantity, packaged with a trial sample, or with updated product packaging.

 

The Store makes a conscientious effort to describe and display its products and services accurately. Despite these efforts, a small number of items in the Store may be mispriced, described inaccurately or unavailable, and we may experience delays in updating information in the Store and in our advertising on other sites. As a result, we cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability and services. The Store reserves the right to change or update information and to correct errors, inaccuracies or omissions at any time without prior notice. We apologize for any inconvenience. If we determine that there were inaccuracies in our product information, we will cancel your order and notify you of such cancellation via email.

 

Colors

 

The Store strives to display as accurately as possible the colors of the products shown on the Site; however, the Store cannot and does not guarantee that your monitor’s display of any color will be accurate.

 

Pricing and Price Corrections

 

Prices shown are in U.S. dollars. If you pay for your order with an international card, the price may fluctuate with exchange rates and/or your card issuer may charge foreign conversion charges and fees.

With respect to items sold by the Store, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items in our catalog may be mispriced. The Store reserves the right to change prices for products at the Store at any time, and to correct inadvertent pricing errors. If the correct price of an item sold by the Store is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. Other merchants may follow different policies in the event of a mispriced item. 

 

We generally do not charge your credit card until after your order has entered the shipping process or, for digital products, until we make the digital product available to you.

 

Order Acceptance/Confirmation

 

The Store’s acknowledgement of an order indicates that your order request has been received; it does not signify that your order has been accepted, shipped, or that the price or availability of an item has been confirmed. The Store reserves the right to refuse or cancel any order or limit the order quantity. Additional qualifying information may be required before processing any order. Upon receiving your online or phone order, we will send you an email confirmation. This order confirmation does not signify acceptance of your order or constitute confirmation of our offer to sell; it simply confirms that we have received your order. The Store reserves the right to accept or decline your order at any time for any reason. If the Store cancels an order after payment has been made, a refund will be issued.

 

Limitations on Quantity

 

We reserve the right to limit quantities on orders placed by the same account, on orders placed by the same method of payment, and on orders that use the same billing or shipping address. We will notify you if such limits are applied. The Store reserves the right to prohibit purchases of any merchandise to resellers. Resellers are defined as a company or an individual that purchases goods with the intention of selling them rather than using them.

 

Rules for Promotions

 

Any coupons, discounts, sweepstakes, contests, raffles, or other promotions (collectively, "Promotions") made available through the Store may be governed by rules that are separate from these Terms & Conditions. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. Gift Cards & Certificates

 

All gift cards, e-gift cards, and other gift certificates are deemed purchased in and issued from the State of Arizona. The risk of loss and title to such items passes to the purchaser upon our electronic transmission to the recipient or delivery to the carrier, whichever is applicable.

Disputes
